In this case Mary Joyce Barker sued Pat James to recover compensatory and punitive damages for personal injuries received by the plaintiff as a result of an alleged assault and battery inflicted on her by the defendant. A counterclaim was filed also alleging assault and battery and seeking recovery of compensatory and punitive damages; however, the counterclaim was withdrawn on defendants motion prior to the submission of the case for decision. The jury returned a verdict for the defendant from which the plaintiff appeals.
